  1. License Agreement
  2.  
  3. NOTICE:  
  4. Actual Software licenses the software to you only upon the condition 
  5. that you accept all of the terms contained in this license agreement.  
  6. Before you install the software, please read the terms and conditions 
  7. of the agreement.  By installing, copying, or otherwise using any of 
  8. the software, you agree to be bound by the terms of this agreement.  If 
  9. you do not agree to the terms of this agreement, you are not authorized 
  10. to use the software.

  12. LICENSE:
  13. The software that accompanies this license (the "Software") is the 
  14. property of Actual Software or its licensers and is protect6ed by 
  15. copyright law.  While Actual Software continues to own the Software 
  16. you will have certain rights to use the Software after your acceptance 
  17. of this license.  Your rights and obligations with respect to the use 
  18. of this Software are as follows:

  20. 1) Actual Software grants to you a personal, non-exclusive, 
  21. non-transferable and royalty-free license to install and use the 
  22. Software for your lawful personal use.  The Software may be installed 
  23. only on computers and handheld devices controlled by you.
  24. 2) You may make copies of the Software as may be necessary for backup 
  25. and archival purpose.
  26. 3) Under no circumstances are you allowed to distribute the Software.

  28. DISCLAIMER OF WARRANTY
  29.  
  30. Actual Software expressly disclaims any warranty for the Software.  
  31. The Software and any related documentation is provided "AS IS" without 
  32. warranty of any kind, either express or implied, including, without 
  33. limitation, the implied warranties or merchantability, fitness for a 
  34. particular purpose, or non-infringement.  The entire risk arising out 
  35. of use of performance or the Software remains with you.
  36.  
  37. LIMITATION OF LIABILITY:
  38. You must assume the entire risk of using the Software.  Any liability 
  39. of the seller will be limited exclusively to product replacement or 
  40. refund of  purchase price.  The Software is not specifically developed 
  41. or licensed for use in any nuclear, aviation's, mass transit, life 
  42. support, medical or any other inherently dangerous applications, or 
  43. commercial applications.

  45. U.S. GOVERNMENT RIGHTS:
  46. If you are acquiring the Software on behalf of any part of the United 
  47. States Government, the following provisions apply.  The Software is 
  48. deemed to be "commercial software" pursuant to DFAR Section 227.7202 
  49. and FAE 12.212, as applicable.  Any use, modification, reproduction, 
  50. release, performance, display or disclosure of the Software by the U.S. 
  51. Government or any of its agencies shall be governed solely by the terms 
  52. of this agreement and shall be prohibited except to the extent expressly 
  53. permitted by the terms of this agreement.

  55. GENERAL:
  56. This agreement will be governed by the state of Massachusetts.  
  57. This agreement may only be modified by a license addendum that 
  58. accompanies this license or by a written document, which has been 
  59. signed by both you and Actual Software.  Should you have any questions
